Malawi Leads the Way in Strengthening Civic Space and Rule of Law.

Lilongwe, Malawi – December 16, 2024 – In a landmark event, Malawi has become the first African nation to unite its Executive, Legislature, Constitutional Commissions, and civil society in a collaborative effort to strengthen civic space and the rule of law. The signing of the Civic Space Pact, held at the Bingu International Convention Centre, marks a significant step towards fostering a culture of respect for human rights and access to justice.

The Africa Judges and Jurists Forum (AJJF) proudly participated in this historic multi-stakeholder process. Represented by Legal Advisor Arnold Tsunga, the AJJF conveyed greetings from its leadership, including President Dr. Willy Mutunga, Chairperson Justice Moses Chinhengo, and Secretary General Martin Masiga.

Tsunga emphasized the crucial interconnectedness of the rule of law and civic space, highlighting their fundamental importance for democracy, human rights, governance, and sustainable development. He quoted Bossuyt and Ronceray’s definition of civic space as “the public arena in which citizens can freely intervene, organise themselves…defending their interests, values, and identities; to claim their rights; to influence public policy and to call power holders to account.”

The AJJF underscored the symbiotic relationship between these two concepts, explaining that the rule of law enables civic space, while a vibrant civic space, in turn, fosters respect for the rule of law. This mutually reinforcing dynamic is essential for sustainable development across Africa.

The AJJF lauded Malawi’s pioneering initiative, recognizing its potential as a model for other African nations. The Forum is now exploring the scalability of this approach across its operational areas, aiming to support the rule of law and development throughout the continent.
